Biden: 'Thank God' Kagan Wasn't a Judge

Then-Harvard dean was right to oppose military recruiters: VP

Joe Biden's glad Elena Kagan was never a judge, and he says she was justified in trying to kick military recruiters off the Harvard Law School campus. “She's gonna be a superb justice,” he said on ABC's Good Morning America today. Asked about the military recruiters, he replied, “She was right,” clarifying that the then-dean was merely reverting to a long-held school policy.

“This is not a single bit of anti-military bias," the VP said. "She does think, and I agree with her, that the don't-ask-don't-tell policy is a very bad policy.” As for the solicitor general's lack of judicial experience, Biden said, “It's not a deal breaker. Thank God it isn't. … Thank God there's been people other than Circuit Court of Appeals justices.” He noted that revered justices like William Rehnquist, Thurgood Marshall, and Hugo Black were never judges.
