While Subway waits to hear whether its bid to trademark the word "footlong" is successful, it's been sending out cease-and-desist letters to sandwich shops that dare to use the phrase. Now Iowa-based Casey's is fighting back (and getting some publicity to boot), notes the Consumerist, via the Des Moines Register. The Midwest chain is challenging the sandwich giant's claim to the term and seeking unspecified damages over Subway's "frivolous" claims.
"Casey's has and will continue to use 'footlong' to describe a sandwich," says the company, which is seeking a jury trial.
