Fitzgerald urges judge to rule against release pending appeal

The prosecutor in the Scooter Libby case wants the judge to send the vice president's ex-chief of staff to prison sooner rather than later. Arguing that the chance of an appeals court overturning the conviction is "at best, remote," Patrick Fitzgerald filed documents today calling for Libby's 30-month sentence to begin no more than 60 days after a hearing Thursday.

Meanwhile, the freshly convicted felon apparently did himself no favors by enlisting 12 prominent law professors, including Alan Dershowitz and Robert Bork, to file a brief on his behalf. It not only riled up the prosecutor by questioning his appointment, but also moved Judge Reggie Walton to append a sarcastic footnote to his order admitting it to the record.
