Looks like Bruce Jenner wasn't texting when he caused a fatal accident yesterday—so vehicular manslaughter charges may not be in the offing, TMZ reports. A photo snapped by an "independent photo agency" (TMZ's words) shows the former Olympian with a cigarette in his hand when he slammed into a Lexus, pushing it into traffic in Malibu, Calif., and killing the car's driver, a woman in her 70s. Five others were also injured. But the Los Angeles County Sheriff's Dept. is still reviewing cell phone records and seeking surveillance video for further clues, USA Today reports. A sheriff's sergeant says Jenner wasn't being pursued by paparazzi at the time, but the LA Times reports that paps and onlookers quickly swarmed the crash scene. "It was a nightmare," the sergeant says. (More paparazzi stories.)
